Welcome to GakuseiDreamers. These Terms of Service ("Terms") govern your use of the website gakuseidreamer.com, the game Realm of Legends, and any other services we provide (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using our Services, you confirm that you have read, understood, and agree to these Terms. If you do not agree, you must not use our Services.

You must be at least 13 years of age to use our Services. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Account Creation

Our Services use Firebase Anonymous Authentication to create your account automatically. This means:

  • An account is created for you without requiring a username, email, or password.
  • Your account is tied to your device and browser. Clearing your browser data or uninstalling the app may result in loss of your account.
  • You are responsible for maintaining access to your account.
  • You may only maintain one account per person. Creating multiple accounts to gain unfair advantages is prohibited.

3. Virtual Currency and In-Game Items

Our games may include virtual currencies (such as "Gems") and virtual items. Regarding these:

  • Virtual currencies and items have no real-world monetary value and cannot be exchanged for real money.
  • Virtual currencies and items are licensed to you, not sold. You do not own them.
  • We reserve the right to modify, manage, regulate, control, or remove virtual currencies and items at our sole discretion.
  • Transfers of virtual currencies or items between accounts are not permitted unless explicitly supported by an in-game feature.
  • Virtual currency purchases are non-refundable except as required by applicable law.

4. In-App Purchases

Our Services may offer in-app purchases. By making a purchase, you agree to the following:

  • All purchases on the web are processed through Stripe. Purchases on Android are processed through Google Play.
  • You are responsible for all charges incurred through your account.
  • Prices are listed in the applicable currency and may vary by region.
  • We reserve the right to change prices at any time without prior notice.
  • Refund requests are handled according to the platform's refund policy (Stripe or Google Play). Contact the respective platform for refund inquiries.
  • Chargebacks or fraudulent refund claims may result in account suspension or termination.

5. User Conduct

When using our Services, you agree not to:

  • Cheat or exploit: Use unauthorized third-party tools, bots, scripts, mods, hacks, or exploits to gain an unfair advantage or manipulate the game.
  • Harass others: Engage in bullying, threatening, abusive, or hateful behavior toward other users.
  • Impersonate: Pretend to be another person, a GakuseiDreamers employee, or any other entity.
  • Disrupt services: Attempt to interfere with, disrupt, or place undue burden on our servers or networks.
  • Reverse engineer: Decompile, disassemble, or reverse engineer any part of our Services.
  • Sell accounts: Buy, sell, trade, or transfer your account or any virtual items for real-world money or value outside of our Services.
  • Share inappropriate content: Post or transmit content that is illegal, obscene, defamatory, or violates any third-party rights.

6. Intellectual Property

All content in our Services — including but not limited to game design, graphics, artwork, characters, music, sound effects, text, code, and trademarks — is owned by GakuseiDreamers or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use our Services for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or create derivative works based on our content without our prior written consent.

7. User-Generated Content

If our Services allow you to submit content (such as feedback, suggestions, or bug reports), you grant us a worldwide, royalty-free, perpetual, irrevocable license to use, modify, and distribute that content in connection with our Services. You retain ownership of your content, but you acknowledge that we may use your feedback to improve our games without compensation.

8. Limitation of Liability

To the maximum extent permitted by law:

  • Our Services are provided "as is" and "as available" without warranties of any kind, express or implied.
  • We do not guarantee that our Services will be uninterrupted, error-free, or secure.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services.
  • Our total liability for any claims related to our Services shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
  • We are not responsible for data loss resulting from device changes, browser data clearing, app uninstallation, or events outside our control.

9. Termination

We reserve the right to suspend or terminate your account and access to our Services at any time, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms
  • Cheating or exploiting game mechanics
  • Fraudulent purchase activity
  • Abusive behavior toward other users or staff
  • Extended periods of inactivity (accounts inactive for 12+ months may be subject to deletion)

Upon termination, your right to use our Services ceases immediately. Any virtual currencies, items, or progress associated with your account will be forfeited. We are not obligated to provide refunds for terminated accounts except as required by law.

10. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

  • Update the "Last updated" date at the top of this page
  • Provide a notice within the game or on our website
  • For significant changes, require your acknowledgment before continued use

Your continued use of our Services after changes are posted constitutes your acceptance of the updated Terms.

11. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of Minnesota, United States, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or our Services shall first be attempted to be resolved through informal negotiation. If a dispute cannot be resolved informally within 30 days, it shall be resolved through binding arbitration in the State of Minnesota, except that either party may seek injunctive relief in court for intellectual property violations.

You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

12. Indemnification

You agree to indemnify and hold harmless GakuseiDreamers and its affiliates, officers, and employees from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of our Services or violation of these Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GakuseiDreamers regarding your use of our Services and supersede all prior agreements.
